The present book verses on the current discussion, between authors writing within the Thomistic tradition, on the issue of human rights, and pretends to adjudicate that discussion. The positions of authors who are critical of the notion of human rights, like Michel Villey and Alasdair MacIntyre, as well as that of those who try to justify their existence and explain their nature, like Jacques Maritain, John Finnis, and others, are carefully explained and evaluated. This book is the first to deal (...) in detail with this contemporary discussion and therefore represents an important contribution to the bibliography on the philosophy of human rights, as well as to the bibliography on the Thomistic tradition. The somatic mutation theory (SMT) of cancer has been and remains the prevalent theory attempting to explain how neoplasms arise and progress. This theory proposes that cancer is a clonal, cell‐based disease, and implicitly assumes that quiescence is the default state of cells in multicellular organisms. The SMT has not been rigorously tested, and several lines of evidence raise questions that are not addressed by this theory. Herein, we propose experimental strategies that may validate the SMT. We also call attention (...) to an alternative theory of carcinogenesis, the tissue organization field theory (TOFT), which posits that cancer is a tissue‐based disease and that proliferation is the default state of all cells. The somatic mutation theory has been the prevailing paradigm in cancer research for the last 50 years. Its premises are: (1) cancer is derived from a single somatic cell that has accumulated multiple DNA mutations, (2) the default state of cell proliferation in metazoa is quiescence, and (3) cancer is a disease of cell proliferation caused by mutations in genes that control proliferation and the cell cycle. From this compelling simplicity, an increasingly complicated picture has emerged as more than 100 (...) oncogenes and 30 tumor suppressor genes have been identified. To accommodate this complexity, additional ad hoc explanations have been postulated. After a critical review of the data gathered from this perspective, an alternative research program has been proposed. It is based on the tissue organization field theory, the premises of which are that carcinogenesis represents a problem of tissue organization, comparable to organogenesis, and that proliferation is the default state of all cells. For the last 50 years the dominant stance in experimental biology has been reductionism in general, and genetic reductionism in particular. Philosophers were the first to realize that the belief that the Mendelian genes were reduced to DNA molecules was questionable. Soon, experimental data confirmed these misgivings. The optimism of molecular biologists, fueled by early success in tackling relatively simple problems has now been tempered by the difficulties encountered when applying the same simple ideas to complex problems. We analyze three (...) examples taken from experimental data that illustrate the shortcomings of this sort of reductionism. In the first, alterations in the expression of a large number of genes coexist with normal phenotypes at supra-cellular levels of organization; in the second, the supposed intrinsic specificity of hormonal signals is negated; in the third, the notion that cancer is a cellular problem caused by mutated genes is challenged by data gathered both from the reductionist viewpoint and the alternative view proposing that carcinogenesis is development gone awry. As an alternative to reductionism, we propose that the organicist view is a good starting point from which to explore these phenomena. However, new theoretical concepts are needed to grapple with the apparent circular causality of complex biological phenomena. (shrink)

In this paper, we try to expose the fundamental ideas at the basis of Jorge Millas’ axiology. First, we will expose synoptically the core of the legal philosophy that the Chilean thinker develops on his works on the subject, including his conception about philosophy in general , and about legal science in particular . Secondly, we will expose the epistemological suppositions of his legal philosophy , and his consequent conception of law’s essence , the legal rule and its foundation, and (...) the axiological theory that Millas develops on the basis of the distinction and relationship between “is” and “ought” . We conclude with a critical analysis that pretends to expose the strengths and weaknesses of the legal theory of this Chilean author. (shrink)

This paper examines accounts of the moral wrongness of killing persons in addition to determining what conclusions, if any, can be drawn from the morality of killing persons about the equality of persons, and vice versa. I will argue that a plausible way of thinking about the moral wrongness of killing implies that the permissibility of killing innocent, nonthreatening persons depends on a person’s age. I address objections to this conclusion and discuss some potential implications of the view.

Norms have been widely enacted in human and agent societies to regulate individuals’ actions. However, although legislators may have ethics in mind when establishing norms, moral values are only sometimes explicitly considered. This paper advances the state of the art by providing a method for selecting the norms to enact within a society that best aligns with the moral values of such a society. Our approach to aligning norms and values is grounded in the ethics literature. Specifically, from the literature’s (...) study of the relations between norms, actions, and values, we formally define how actions and values relate through the so-called value judgment function and how norms and values relate through the so-called norm promotion function. We show that both functions provide the means to compute value alignment for a set of norms. Moreover, we detail how to cast our decision-making problem as an optimisation problem: finding the norms that maximise value alignment. We also show how to solve our problem using off-the-shelf optimisation tools. Finally, we illustrate our approach with a specific case study on the European Value Study. (shrink)

Some authors view the veil of ignorance as a preferred method for allocating resources because it imposes impartiality by stripping deliberators of knowledge of their personal identity. Using some prominent examples of such reasoning in the health care sector, I will argue for the following claims. First, choice behind a veil of ignorance often fails to provide clear guidance regarding resource allocation. Second, regardless of whether definite results could be derived from the veil, these results do not in themselves have (...) important moral standing. This is partly because the veil does not determine which features are morally relevant for a given distributive problem. Third, even when we have settled the question of what features to count, choice behind a veil of ignorance arguably fails to take persons seriously. Ultimately, we do not need the veil to solve distributive problems, and we have good reason to appeal to some other distributive model. (shrink)

El nominalismo es normalmente asociado con una concepción voluntarista de la ley natural, sobre todo por la asociación de ambas doctrinas en la obra de Guillermo de Ockham. Sin embargo, no existe una conexión necesaria entre tales doctrinas, y para mostrar aquello, se expondrá la doctrina de Thomas Hobbes al respecto. En este autor, el nominalismo filosófico, más extremo que el de Ockham, se encuentra asociado a una concepción totalmente necesitarista de la ley natural, hasta el punto de que puede (...) decirse que en Hobbes existe, en materia moral, una inversión de la doctrina ockhamista. En ambos casos hay recurso a Dios, pero en el caso de Ockham, para suministrar el contenido de la ley natural y, en el caso de Hobbes, para garantizar el carácter obligatorio de ésta. (shrink)

David Waldron Smithers was, among other things, a physician and a pioneer of cancer radiotherapy and a well-respected figure in British medicine and public health. From the 1940s until his retirement from medical practice in 1973, he was the director of the Radiotherapy Department at the Royal Marsden Hospital and London University Chair of Radiotherapy at the Institute of Cancer Research. Using massive amounts of clinical observations, which he interpreted from an organicist viewpoint, and his impressive synthetic thinking, he proposed (...) a coherent alternative perspective to the somatic mutation theory (SMT) which was then, and still is, the dominant theory of cancer. The purpose of this essay is to acquaint the modern audience with his seminal paper, published in 1962, because it deserves to be recognized as a true classic. In it, he examined the lack of fit between clinical observations and the SMT and proposed the rejection of this reductionist perspective. In addition, he built an organicist alternative in which carcinogenesis is seen as a problem of biological organization. His conceptual contribution to the cancer problem has inspired us and other authors over the last two decades. This text explores a set of key concepts in Marxist theory as developed and read by Lacan, demonstrating links and connections between Marxist thought and Lacanian practice. The book examines the complexity of these encounters through the structure of a comprehensive vocabulary which covers diverse areas, from capitalism and communism to history, ideology, politics, work, and family. The aim of this text is to examine the issue of truth telling in doctor-patient relationships, namely in the case of terminal patients. We analyze the problems and attitudes regarding truth telling that there are present when patients suffer from mortal diseases. We conclude that it is very important to keep a fluent and truthful communication in the doctor-patient relationship. We also examine and stress the role that general practitioners can play in the care of terminal patients at their home (...) and with their friends and/or relatives. (shrink)

I argue that the claim that all value is conferred is incompatible with the view that the capacity to set ends is unconditionally valuable. While this objection has been made, I offer a rebuttal and then a counterexample to the rebuttal. I also argue that, if all value were conferred, then the Kantian notion that moral wrongness consists in a practical contradiction is undermined.

In 1929 and 1930 Wittgenstein holds some form of Phenomenology. This is a most surprising development of his thought. His Tractatus Logico-Philosophicus, published in 1921, represents a form of Philosophy radically opposed to Phenomenology. And yet, "Some Remarks on Logical Form," of 1929, and Philosophical Remarks, of 1930, each defends a form of Phenomenology, in the sense that in each one finds that Wittgenstein presents a version of the thesis that the phenomena of immediate experience are in some way central (...) to construal of meaningfulness. I study this period of Wittgenstein's Philosophy with the objective of clarifying his concern with the study of the phenomena. It will emerge that he holds not one, but rather two different forms of Phenomenology. "Some Remarks on Logical Form" gives voice to one conception of the phenomena and of their role in the determination of the rules which stipulate meaningfulness. Philosophical Remarks, on the other hand, contains a criticism of this view, as well as a different conception of the phenomena and of their role with respect to the rules of meaningfulness . It also emerges that the former kind of Phenomenology is very similar to the Phenomenology of Edmund Husserl, the founder of Phenomenology. I will examine Wittgenstein's Phenomenology of 1929, its similarity with the Phenomenology of Edmund Husserl, his rejection of this conception, and his Phenomenology of 1930. (shrink)

Over recent years, the research community has been increasingly using preprint servers to share manuscripts that are not yet peer-reviewed. Even if it enables quick dissemination of research findings, this practice raises several challenges in publication ethics and integrity. In particular, preprints have become an important source of information for stakeholders interested in COVID19 research developments, including traditional media, social media, and policy makers. Despite caveats about their nature, many users can still confuse pre-prints with peer-reviewed manuscripts. If unconfirmed but (...) already widely shared first-draft results later prove wrong or misinterpreted, it can be very difficult to “unlearn” what we thought was true. Complexity further increases if unconfirmed findings have been used to inform guidelines. To help achieve a balance between early access to research findings and its negative consequences, we formulated five recommendations: (a) consensus should be sought on a term clearer than ‘pre-print’, such as ‘Unrefereed manuscript’, “Manuscript awaiting peer review” or ‘’Non-reviewed manuscript”; (b) Caveats about unrefereed manuscripts should be prominent on their first page, and each page should include a red watermark stating ‘Caution—Not Peer Reviewed’; (c) pre-print authors should certify that their manuscript will be submitted to a peer-review journal, and should regularly update the manuscript status; (d) high level consultations should be convened, to formulate clear principles and policies for the publication and dissemination of non-peer reviewed research results; (e) in the longer term, an international initiative to certify servers that comply with good practices could be envisaged. Jose Marti contributed greatly to Cuba's struggle for independence from Spain with words as well as revolutionary action. Although he died before the formation of an independent republic, he has since been hailed as a heroic martyr inspiring Cuban republican traditions.

The science of complexity is based on a new way of thinking that stands in sharp contrast to the philosophy underlying Newtonian science, which is based on reductionism, determinism, and objective knowledge. This paper reviews the historical development of this new world view, focusing on its philosophical foundations. Determinism was challenged by quantum mechanics and chaos theory. Systems theory replaced reductionism by a scientifically based holism. Cybernetics and postmodern social science showed that knowledge is intrinsically subjective. These developments are being (...) integrated under the header of “complexity science”. Its central paradigm is the multi-agent system. Agents are intrinsically subjective and uncertain about their environment and future, but out of their local interactions, a global organization emerges. Although different philosophers, and in particular the postmodernists, have voiced similar ideas, the paradigm of complexity still needs to be fully assimilated by philosophy. This will throw a new light on old philosophical issues such as relativism, ethics and the role of the subject. (shrink)

The purpose of the article was to determine the relationship between the organizational culture and the institutional management of the "Enrique López Albújar" Educational Institution, Piura. Work is worked under a quantitative approach, descriptive and correlational scope, 40 teachers participated as a sample. Among the results, it was found that there is no significant relationship between organizational culture and institutional management, which did not allow validating the research hypothesis; However, a significant relationship between norms and customs with institutional management was (...) found; which concludes in compliance with the norms and good customs based on values. Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)
